1. Acceptance of Terms

By accessing or using Claymotion ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Claymotion is an AI-powered platform that generates claymation-style videos from text descriptions and uploaded assets. The Service includes video generation, script writing, scene editing, voiceover synthesis, and related tools.

3. User Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must notify us immediately of any unauthorized use of your account.
You must be at least 13 years old to use the Service.
One person or entity may not maintain more than one free account.

4. Subscriptions & Payments

4.1 Plans

The Service offers free and paid subscription plans. Features, video limits, and capabilities vary by plan. Current plan details are available on our Pricing page.

4.2 Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

4.4 Price Changes

We reserve the right to modify pricing with at least 30 days' notice. Price changes will apply at the start of your next billing cycle after the notice period.

5. Content & Intellectual Property

5.1 Your Content

You retain ownership of the text, images, logos, and other materials you upload to the Service ("Your Content"). By uploading, you grant Claymotion a limited license to process Your Content solely for the purpose of providing the Service.

5.2 Generated Videos

Subject to your compliance with these Terms and your active subscription, you receive a worldwide, non-exclusive license to use videos generated by the Service for personal and commercial purposes. Attribution to Claymotion is appreciated but not required on paid plans.

5.3 Our Property

The Service, including its design, code, AI models, branding, and documentation, is owned by Claymotion and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

6. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
Infringe on the intellectual property rights of others.
Create misleading deepfakes or deceptive media intended to harm individuals.
Attempt to gain unauthorized access to the Service or its systems.
Use automated means to scrape, crawl, or extract data from the Service.
Resell or redistribute the Service without our written consent.
Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice.

7. Limitation of Liability

To the maximum extent permitted by law, Claymotion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

9. Indemnification

You agree to indemnify and hold harmless Claymotion, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the jurisdiction of our principal place of business.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
